These Terms and Conditions (“Terms”, “Agreement”) govern your access to and use of the web hosting, domain registration, VPS hosting, dedicated server, website-related and other services (“Services”) provided by HostAcmee (“HostAcmee”, “we”, “us”, or “our”).

By creating an account, purchasing, accessing, or using any of our Services, you (“Customer”, “Client”, “Subscriber”, “you”, or “your”) agree to be bound by these Terms and Conditions, together with any applicable policies, service-specific terms, order forms, invoices, and agreements.

If you do not agree with these Terms, you must not use our Services.

1. General Subscriber Terms

To use our Services, you must provide accurate, complete, and current information during registration and throughout your subscription period.

You are responsible for:

  • Maintaining the confidentiality and security of your account credentials.
  • All activities carried out through your account.
  • Keeping your contact, billing, and account information up to date.
  • Ensuring that your use of our Services complies with all applicable laws and regulations.
  • Ensuring that the content, software, applications, scripts, databases, and other materials hosted under your account are lawful and properly licensed.

You must be at least 18 years of age or otherwise legally capable of entering into a binding agreement to purchase and use our Services.

You may not transfer, sell, assign, or allow unauthorized third parties to use your account without our prior written approval.

We reserve the right to refuse, suspend, restrict, or terminate an account where we reasonably believe that the account is being used for fraudulent, unlawful, abusive, or unauthorized purposes.

2. Services

Host Acmee may provide Services including, but not limited to:

  • Shared web hosting
  • Business web hosting
  • Reseller hosting
  • VPS hosting
  • Dedicated servers
  • Domain name registration and related domain services
  • SSL certificates
  • Email hosting
  • Website maintenance and other related services

The features, specifications, limits, prices, and availability of each Service are subject to the plan purchased by the Customer.

We may modify, replace, upgrade, discontinue, or otherwise change Services, technologies, infrastructure, or features where reasonably necessary for security, legal, technical, operational, or business reasons.

3. Domain Name Registration

Domain name registration, renewal, transfer, management, and related services are subject to our separate Domain Name Registration Agreement.

By registering, transferring, renewing, or managing a domain name through us, you agree to the terms available at:

Domain registration and renewal may also be subject to the policies, rules, requirements, and agreements of the relevant domain registry, registrar, registry operator, or other applicable authority.

The Customer is responsible for ensuring that domain registration details are accurate and kept up to date. Failure to provide or maintain accurate information may result in suspension, cancellation, transfer restrictions, or other actions as required by applicable rules or authorities.

4. Payment and Billing Terms

All Services must be paid for in accordance with the billing cycle selected at the time of purchase.

Unless otherwise stated:

  • Payments are due in advance.
  • Services may not be activated until the applicable payment has been successfully received.
  • Renewal invoices may be issued before the service renewal date.
  • It is the Customer’s responsibility to ensure that payments are made before the due date.
  • Prices may be subject to applicable taxes, including GST, where applicable.
  • The Customer is responsible for providing accurate billing and tax information.
  • Promotional or discounted pricing may apply only for the stated promotional period.

If payment is not received by the applicable due date, we may suspend, restrict, or terminate the affected Service.

Where a payment is disputed, reversed, charged back, or determined to be fraudulent, we may immediately suspend the associated Services while the matter is investigated.

Any bank charges, payment gateway charges, currency conversion charges, or other charges imposed by a third-party payment provider may be the responsibility of the Customer where applicable.

5. Renewal and Expiration

Unless otherwise specifically stated, Services are provided for the subscription period purchased by the Customer.

Customers are responsible for monitoring service expiry dates and ensuring timely renewal payments.

Failure to renew a Service before its expiration may result in:

  • Service suspension or deactivation
  • Loss of website or email accessibility
  • Removal of associated data after the applicable retention period
  • Domain expiration, redemption, deletion, or loss, subject to applicable registry or registrar rules

We are not responsible for losses resulting from a Customer’s failure to renew a Service on time.

6. Refunds and Cancellations

Refund eligibility, if any, is governed by the refund policy applicable to the specific Service or promotion purchased.

Unless expressly stated otherwise, the following may not be eligible for a refund:

  • Domain registrations, renewals, transfers, or redemption fees
  • Services that have already been substantially used or consumed
  • Setup, migration, customization, or administrative fees
  • Third-party products or services
  • Services suspended or terminated because of a violation of these Terms or applicable policies

Customers wishing to cancel a Service must submit a cancellation request through the designated customer support or account management process.

Cancellation of a Service does not automatically cancel any other services associated with the Customer’s account unless specifically requested and confirmed.

7. Infinite Web Space and Fair Usage Policy

Where a hosting plan is advertised as offering “Infinite Web Space”, “Unlimited Storage”, “Unlimited Disk Space”, or similar terminology, such terminology is subject to this Fair Usage Policy.

“Infinite Web Space” does not mean unlimited use of physical server resources without restriction. Our hosting infrastructure is designed primarily for the normal operation of websites, web applications, and related legitimate online services.

Hosting accounts must use storage in a reasonable manner consistent with the purpose of the purchased hosting plan.

The following activities are not permitted unless expressly authorized by Host Acmee in writing:

  • Using a shared hosting account primarily as a remote backup, archive, or storage service.
  • Storing large collections of personal files unrelated to the operation of a website or web application.
  • Operating public or private file-sharing services that consume excessive resources.
  • Storing excessive backups for prolonged periods.
  • Using the account for media distribution, file repositories, or data archiving unrelated to the normal operation of the hosted website.
  • Any activity that unreasonably affects server performance, storage systems, network capacity, or other Customers.

We may review storage usage and, where usage is determined to be excessive, unreasonable, or inconsistent with the intended purpose of the Service, we may request that the Customer reduce, remove, or relocate the affected data.

If the Customer fails to comply within the period specified by us, we may restrict, suspend, or terminate the affected Service.

8. CPU Usage and Server Resource Policy

To maintain server stability and ensure fair access to shared resources, Customers using shared hosting and other non-VPS and non-dedicated server hosting services must not continuously or excessively consume CPU resources.

Customers using Shared Hosting, Business Hosting, Reseller Hosting, or other hosting plans that are not VPS or Dedicated Server plans must not utilize more than 25% of the available CPU resources assigned or permitted for their hosting environment.

This 25% CPU usage policy does not apply to Customers using VPS or Dedicated Server services, which are governed by the resources specifically allocated to their respective plans.

Where a non-VPS or non-Dedicated Server account exceeds or persistently consumes more than the permitted CPU usage, Host Acmee may take one or more of the following actions:

  1. Investigate the cause of the excessive resource consumption.
  2. Contact or notify the Customer using the registered email address or available support channels.
  3. Request the Customer to optimize the website, application, plugin, script, database, cron job, or other resource-intensive component.
  4. Temporarily restrict or suspend the affected processes or account where necessary to protect server stability and other Customers.
  5. Recommend or require an upgrade to a more suitable hosting plan, including a VPS or Dedicated Server where appropriate.
  6. Suspend the hosting account where excessive resource usage continues, creates a significant impact on server stability, or requires immediate action.

Where reasonably practicable, we will notify the Customer before suspension. However, where excessive CPU consumption creates an immediate risk to server performance, security, infrastructure, or other Customers, we may temporarily suspend or restrict the affected account or processes without prior notice. We will notify the Customer as soon as reasonably practicable following such action.

Customers remain responsible for maintaining and optimizing their websites, applications, themes, plugins, scripts, databases, cron jobs, and other software installed on their hosting accounts.

9. Acceptable Use

You must not use our Services for any unlawful, fraudulent, abusive, or unauthorized purpose.

Prohibited activities include, but are not limited to:

  • Hosting or distributing unlawful content.
  • Violating applicable Indian or international laws and regulations.
  • Infringing copyright, trademarks, patents, privacy rights, or other intellectual property rights.
  • Distributing malware, viruses, ransomware, spyware, or other malicious software.
  • Sending spam, unsolicited bulk emails, or engaging in email abuse.
  • Operating phishing, fraud, scam, or deceptive websites.
  • Attempting unauthorized access to computers, networks, accounts, or systems.
  • Performing activities that threaten the security, availability, or integrity of our infrastructure.
  • Using excessive CPU, memory, storage, disk I/O, processes, or network resources.
  • Hosting content intended to harass, threaten, defraud, or unlawfully harm others.
  • Using our Services to facilitate any criminal or illegal activity.
  • Circumventing technical limits, security controls, or account restrictions.
  • Reselling or redistributing Services in a manner not permitted by the purchased plan.

We may investigate suspected violations and cooperate with law enforcement agencies, government authorities, registries, or other legally authorized parties where required by applicable law.

10. Account Suspension and Termination

We may suspend, restrict, or terminate all or part of your Services where:

  • Payment is overdue.
  • You violate these Terms or any applicable policy.
  • Your account creates an excessive risk to server stability, security, or other Customers.
  • Your resource usage exceeds applicable limits, including the CPU usage policy.
  • We receive a valid legal order, government request, abuse complaint, or other legally enforceable instruction.
  • We reasonably suspect fraud, identity abuse, unauthorized payment activity, or illegal activity.
  • You provide materially false or misleading account information.
  • Your use of the Services creates a security risk or operational risk.
  • Continued provision of the Services may violate applicable law.

Where reasonably possible, we will provide notice before suspension or termination. However, immediate suspension may occur without prior notice where necessary to protect our infrastructure, comply with law, prevent abuse, or protect other Customers.

Suspension or termination resulting from a violation of these Terms does not relieve the Customer of any outstanding payment obligations.

11. Customer Data and Backups

Customers are solely responsible for maintaining current and independent backups of their websites, databases, emails, files, applications, and other data.

Any backup service or automated backup feature provided by Host Acmee is offered subject to the specifications and limitations of the applicable Service and should not be treated as the Customer’s only backup solution.

Although we may take reasonable measures to protect our infrastructure, we do not guarantee that data loss will never occur.

Before cancellation, suspension, migration, or termination of a Service, Customers should maintain their own current backup of all important data.

12. Technical Support

The scope of technical support depends on the Service purchased.

Our hosting support generally covers the normal operation of the hosting infrastructure and standard hosting services.

Unless expressly included in a separate agreement, Customers are responsible for:

  • Website development
  • Application configuration
  • WordPress, themes, and plugin optimization
  • Custom code
  • Third-party software troubleshooting
  • Database optimization
  • Website performance optimization
  • Security issues caused by Customer-installed software or code

We may provide reasonable assistance or recommendations where possible, but such assistance does not create an obligation to perform application development, optimization, or custom administration work.

13. Third-Party Software and Services

Our Services may allow or include access to third-party software, applications, payment providers, domain registries, SSL providers, or other external services.

Host Acmee does not control all third-party services and is not responsible for interruptions, changes, failures, discontinuations, or policies of third parties.

The use of third-party products may be subject to additional terms and conditions established by the relevant provider.

14. Service Availability

We aim to maintain reliable and continuous Services. However, uninterrupted or error-free operation cannot be guaranteed.

Services may occasionally be unavailable due to:

  • Scheduled maintenance
  • Emergency maintenance
  • Hardware or infrastructure failures
  • Network or upstream provider failures
  • Power failures
  • Software vulnerabilities or security incidents
  • Cyberattacks
  • Government actions
  • Events beyond our reasonable control

We may temporarily interrupt Services where reasonably necessary for maintenance, upgrades, security, or infrastructure protection.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Host Acmee shall not be liable for any indirect, incidental, special, punitive, or consequential loss or damage, including loss of profits, revenue, business opportunity, goodwill, or data arising from the use of or inability to use our Services.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.

Customers are responsible for maintaining appropriate backups, security measures, and business continuity arrangements suitable for their own requirements.

16. Indemnification

You agree to indemnify and hold Host Acmee, its owners, employees, representatives, and service providers harmless from claims, losses, liabilities, damages, and reasonable expenses arising from:

  • Your violation of these Terms.
  • Your unlawful use of our Services.
  • Content hosted, transmitted, or made available through your account.
  • Your infringement of another person’s intellectual property or legal rights.
  • Your violation of applicable laws or regulations.

17. Changes to Services, Pricing, and Terms

We may update or modify these Terms from time to time for legal, technical, security, operational, or business reasons.

The latest version of these Terms will be published on our website.

Where appropriate, we may notify Customers of material changes through email, account notifications, or other reasonable methods.

Continued use of the Services after the effective date of updated Terms constitutes acceptance of the revised Terms.

Changes to pricing will generally apply to future purchases or renewals unless otherwise stated or required by law.

18. Notices and Communications

You agree that we may send important notices, invoices, service alerts, security notifications, and other communications to the email address associated with your account.

You are responsible for keeping your contact information current and ensuring that emails from Host Acmee are not blocked or filtered.

19. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the applicable laws of India and, where applicable, the laws and rules in force in the State of Tamil Nadu.

Any dispute arising out of or relating to these Terms or the Services shall first be addressed by the parties in good faith in an attempt to resolve the matter amicably.

Subject to any mandatory rights available to consumers under applicable law, disputes that cannot be resolved amicably shall be subject to the jurisdiction of the competent courts in Tamil Nadu, India.

Nothing in these Terms is intended to exclude or restrict any statutory rights or remedies that cannot lawfully be excluded. Indian online-service terms commonly use Indian law with Tamil Nadu/Chennai jurisdiction clauses, while preserving mandatory legal rights.

20. Compliance with Applicable Laws

Customers must comply with all applicable laws, regulations, governmental requirements, and legally binding orders relevant to their use of our Services.

This includes, where applicable, laws relating to:

  • Information technology and electronic communications
  • Cybersecurity and unauthorized access
  • Data protection and privacy
  • Intellectual property
  • Consumer protection
  • Taxation
  • Electronic transactions
  • Content and online communications

The Customer shall not use our Services in a manner that causes Host Acmee to violate applicable Indian law, Tamil Nadu law, or any other law that legally applies to the Service or Customer’s use of the Service.

21. Force Majeure

Host Acmee shall not be liable for any delay, interruption, or failure to perform caused by circumstances beyond our reasonable control, including natural disasters, fire, flood, power failures, internet or telecommunications failures, cyberattacks, acts of government, war, civil disturbances, labour disputes, or failures of third-party infrastructure providers.

22. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a competent authority or court, that provision shall be interpreted or modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

23. No Waiver

Our failure to enforce any provision of these Terms on one or more occasions shall not constitute a waiver of our right to enforce that provision or any other provision in the future.

24. Entire Agreement

These Terms, together with the applicable service-specific terms, policies, invoices, order forms, Privacy Policy, Domain Name Registration Agreement, and any other agreements expressly incorporated by reference, constitute the agreement between you and Host Acmee regarding the applicable Services.
